HB 254 establishes a rebuttable presumption that employers or agents of employers who disclose information about an employee’s job performance or work record to prospective employers, are acting in good faith; entitles said employers to immunity from civil liability for said disclosures or their consequences, unless lack of good faith, as defined, is demonstrated. This bill provides employers with liability protection from civil suits arising out of the employee reference process. Not only does this bill offer protection for former employers but it could provide future employers with more accurate information about a prospective employee's job performance and work record.
